1. Agreement to Terms

By creating a Zormly account or using our form builder platform, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you are prohibited from utilizing any services hosted by Zormly. These Terms apply to all visitors, users, and others who access or use the Service.

2. Subscriptions, Billing, and Refunds

Our billing cycles are managed securely through Dodo Payments. By upgrading your workspace to a Pro or Team tier, you agree to pay all related fees in accordance with the billing terms in effect at the time.

  • Plan Limits: Form creations, monthly response counts, workspace members, and file uploads are restricted by your active tier quotas. Over-quota views are paused until plans are upgraded or the next calendar month begins.
  • Renewals: Subscriptions automatically renew unless canceled prior to the end of the current billing cycle.
  • Refund Policy: We offer a 14-day money-back guarantee for initial subscription purchases. After 14 days, all purchases are final and non-refundable. No partial refunds are issued for unused time upon cancellation.

3. Acceptable Use & Content Guidelines

You are solely responsible for all content, text, questions, and uploaded files inside your workspaces. You agree NOT to use Zormly to:

  • Collect highly sensitive personal information (e.g., Social Security Numbers, full credit card details) without proper encryption and authorization.
  • Conduct phishing attacks, credential harvesting, or distribute malware, viruses, or destructive code.
  • Host or distribute content that is illegal, abusive, harassing, defamatory, or violates intellectual property rights.

Zormly reserves the right to immediately suspend or terminate accounts and delete forms that violate this Acceptable Use Policy, without prior notice or refund.

4. Intellectual Property Rights

Our IP: Zormly retains all rights, title, and interest in our proprietary software, databases, custom designs, visual themes, logos, and trademarks. You may not copy, modify, or reverse-engineer our platform.

Your IP: You retain full ownership rights over the forms you create and the response data collected inside your databases. By using Zormly, you grant us a limited, worldwide license to host, store, and process this data solely for the purpose of providing the Service to you.

5. Disclaimer of Warranties

Zormly services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, express or implied, including but not merchantability, fitness for a particular purpose, and non-infringement. Zormly does not warrant that the services will be uninterrupted, entirely secure, or error-free.

6. Limitation of Liability

To the maximum extent permitted by law, in no event will Zormly, its developers, directors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for all claims related to the Service shall not exceed the total amount paid by you to Zormly during the past twelve (12) months.

7. Indemnification

You agree to defend, indemnify, and hold harmless Zormly and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

8. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration conducted in Delaware, except that you may assert claims in small claims court if your claims qualify.
